1. Article 142 and Deemed Assent: SC Ruling on Bills

  • A five-judge bench led by CJI B.R. Gavai held that Article 142 cannot create 'deemed assent' for Bills pending with governors or the President.
  • It overruled an earlier two-judge Tamil Nadu bench that tried to set timelines for assent.
  • The President's options under Article 111 are assent, withhold, return an ordinary Bill, or reserve; a Money Bill cannot be returned.
  • Under Article 200, a Governor can assent, withhold, return an ordinary Bill, or reserve it for the President.
