3. VDA Taxation in Income Tax Bill 2025: Key Rules

  • Income Tax Bill, 2025 defines virtual digital assets in Section 2(111), explicitly including NFTs, and excludes Indian and foreign currency.
  • VDA transfers attract a flat 30% tax; only acquisition cost is deductible, and 1% TDS applies to all VDA transactions including P2P.
  • VDAs are classed as property (Section 92(5)(f)) and capital assets (Section 76(1)).
  • Unreported VDA holdings can be treated as undisclosed income (Section 301); dealers must report under Section 509.
