EDF for services exports: 30-day filing deadline under new FEMA rules
Why in the news
On 15 October 2026, reports highlighted that the new FEMA export-import regulations, in force since 1 October 2026, bring services exporters such as IT and consulting firms under a fixed Export Declaration Form (EDF) filing deadline.
Key facts
- Regulations: Foreign Exchange Management (Export and Import of Goods and Services) Regulations, 2026, effective 1 October 2026; they consolidate rules for cross-border trade transactions.
- EDF for services: to be filed within 30 days after the end of the month in which the invoice is raised.
- If payment is received earlier, the EDF must be filed on or before the date of payment.
- Consolidated EDF: a single form can cover several invoices of the same month, even to different overseas clients. For example, October 2026 invoices can be covered by one EDF filed by 30 November.
- Each invoice must show the client name, country, invoice number and date, currency, value and nature of service.
- Software remains a service; the SOFTEX process is expected to continue where applicable.
- AD banks (authorised dealer banks) get a larger role, handling EDF filings for Domestic Tariff Area exporters and extension requests.
Realisation timelines
| Export type | Period to realise proceeds |
|---|---|
| Goods | 9 months from shipment |
| Services (including software) | 9 months from invoice date |
| Invoiced or settled in Indian rupees | 12 months |
About EDF
Under the new framework, each invoice covered by an EDF is reported with client and value details, and the authorised dealer bank is the exporter’s main point of contact for procedures and document checklists. Exporters unable to meet the realisation deadline may seek an extension from their AD bank with reasons and documents. Units in the Domestic Tariff Area may file through their AD bank or STPI, while SEZ units deal with the Development Commissioner.
Exam angle
- The framework is linked to the Reserve Bank of India and widens the role of AD banks.
- Remember the numbers: 30 days (EDF), 9 months (realisation), 12 months (rupee exports).
- Know the roles of AD banks, SOFTEX and STPI in export compliance.
